First Death by Autonomous Vehicle
On Sunday, March 18, at 10 pm the first person in history to be killed by an autonomous vehicle (by force of impact) occurred in Temple, Arizona.
Uber's Volvo XC90 SUV was traveling at 38mph and operating under "autonomous mode" when it struck Elaine Herzberg who was walking her bike across the street. The victim was quickly transported to a hospital but later died due to her injuries.
Although Uber's self-driving car had a human in the driver's seat (as required by state law at the time) she was unable to take back control of the vehicle fast enough to prevent the incident from happening.
This incident adds to the controversy of whether autonomous vehicles are ready to be operating on public roads, despite the lack of laws that are equipped to handle situations like the one involving Elaine Herzberg.
Right now, there are hundreds of self-driving vehicles being tested on public roads in states that have implemented loose regulations for big tech companies, such as California, Nevada, and Arizona.
Since a human was not behind the wheel of the vehicle, people were quick to wonder who would be liable for her death.
Should the company operating the self-driving vehicle be liable? Should the company behind the technology be liable? How will justice be served if technology is at fault?
Lawmakers have been slow to regulate autonomous vehicles because of the difficult question that must be answered.
We can only hope regulators will be ready when these vehicles start hitting the showroom floors in the near future.
